New product warranty for AML Microwave Products:

a)	The AML products sold by AML Wireless Systems, Inc. are warranted to the original Buyer to conform to published specifications current at time of sale and to be free of defects in workmanship and materials for the warranty period.
b)	Seller's entire liability is strictly limited to making adjustments by repairing or replacing any product manufactured by AML Wireless Systems, Inc. that fails to meet this warranty and which is returned to Seller within the original warranty period. Replacement, repairs or adjustments under this warranty shall not reinstate this warranty. The warranty period is twelve months from date of original shipment.
c)	Adjustment will not be allowed for products which have been subjected to abuse, improper application or installation, alteration or damage in storage, transportation, handling, accidental or negligent damage in use. Alteration or removal of serial numbers or identification marking voids the warranty.
d)	Seller shall have the right of final determination as to the following (a) existence and cause of a defect, (b) whether adjustment will be allowed, and (c) if allowed, whether adjustment will be by repair or replacement. If Seller determines that a product is subject to warranty adjustment, then Seller, at its option, will either (i) repair or replace the product if the defect materially impairs performance of the system of which it forms a part, or (ii) if the defect, including any deviation from specifications, does not materially impair performance of the system, make an equitable adjustment on the purchase price of the product.
e)	If Seller determines that a product claimed to be defective is not subject to the warranty provision set forth herein, Buyer will be notified that product is not subject to adjustment. When adjustment is not allowed, a reasonable charge will be made to Buyer to cover Seller's cost of inspection and handling. Unless the Buyer furnishes disposition instructions for the product within thirty (30) days after such notification, Seller may return the product "as is" to Buyer, transportation collect.
f)	In returning products under warranty, Buyer in all cases will obtain and comply with Seller's packaging and shipping instructions. Buyer will pay for packing, transportation and transit insurance costs for returned products.
g)	Seller's liability under the warranties set forth in paragraph 9 (sections a through f) is in lieu of all other warranties expressed or implied, including any implied warranty of merchantability or fitness for a particular purpose, and in no event shall AML Wireless Systems, Inc. be liable for collateral, consequential or incidental damages, including but not limited to loss of use, revenue or profits.
